Welcome to XTranslate and TranslateGPT!
These Terms of Service (this “Agreement”) is between you, and XTranslate and TranslateGPT (operated by ZQ Labs, Inc. ). By using our applications on phones, our websites, and/or other services we provide, you agree to be bound by this Agreement. You’re not allowed to copy, or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages, or make derivative versions. The app itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, still belong to ZQ Labs, Inc. . If you do not agree to be bound by this Agreement, you may not use the Services. Your use of, or participation in, certain Services may be subject to additional terms which will be presented to you when you access those Services.
XTranslate and TranslateGPT (operated by ZQ Labs, Inc. ) is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

We reserve the right to terminate or suspend your account if we suspect any misuse or violations of these terms.
Our service is provided "as is" and we make no guarantees or warranties regarding its accuracy or reliability.
We are not responsible for any losses or damages resulting from the use of our service.
We may update these terms and conditions at any time, and your continued use of our service signifies your acceptance of any changes.
Indemnification
You agree to indemnify, defend, and hold harmless XTranslate and TranslateGPT, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your use of our service.
Limitation of Liability
You agree that XTranslate and TranslateGPT will not be liable to you for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses arising out of or in connection with your use of our service.
In particular, customer may not, and will not allow third parties (including Internal Users and End Users) to use the Products, responses created using the Products, Documentation or other data, information or service provided by XTranslate and TranslateGPT(by ZQ Labs, Inc.)
- a) in connection with or for the purpose of operating critical infrastructure such as electrical power stations, military or defence equipment, medical appliances or other equipment whose failure or impairment would result in unforeseeable economical or physical damages;
- b) for any illegal activities, including development of any applications infringing any third-party rights or any other applicable laws or regulations;
- c) for spamming or any other unsolicited advertising;
- d) to perform benchmark or other capacity testing of our products technical infrastructure;
- e) to create a similar product, service or API whose primary purpose is to provide machine translation services, including but not limited to bilingual/multilingual dictionaries;
- f) to develop, market or train a machine translation algorithm;
- g) to transmit any data to XTranslate and TranslateGPT which may not be transmitted to or processed by us due to data protection laws, contractual or statutory confidentiality obligations, export restrictions or other statutory provisions or third-party rights.
Governing Law and Jurisdiction
These terms and conditions will be governed by and construed in accordance with the laws of United States or other countries including the country in which you are resident or from which you use the Services, and any disputes arising out of or in connection with these terms and conditions will be subject to the exclusive jurisdiction of the courts of United States.
Data privacy
You confirm that you have read and understand our privacy policy and you give consent to the processing of your data in accordance with it.
Third-Party Services:
Our service may make use of third-party services and technology. By using our service, you acknowledge and agree that we are not responsible for any such third-party services, and that any use of such services is at your own risk.
Waiver of Rights.
XTranslate and TranslateGPT’s (operated by ZQ Labs, Inc. ) failure to enforce any right or provision of this Agreement will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of XTranslate and TranslateGPT (operated by ZQ Labs, Inc. ). Except as expressly set forth in this Agreement, the exercise by either party of any of its remedies under this Agreement will be without prejudice to its other remedies under this Agreement or otherwise.
Waiver of Rights.
XTranslate and TranslateGPT’s (operated by ZQ Labs, Inc. ) failure to enforce any right or provision of this Agreement will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of XTranslate and TranslateGPT (operated by ZQ Labs, Inc. ). Except as expressly set forth in this Agreement, the exercise by either party of any of its remedies under this Agreement will be without prejudice to its other remedies under this Agreement or otherwise.
Changes to This Terms and Conditions
I may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. I will notify you of any changes by posting the new Terms and Conditions on this page. These changes are effective immediately after they are posted on this page.
